2. In order to make the services provided by the Vendor more efficient and improve them, the Customer Zone has been established, serving primarily for the Customer to purchase a Ticket.
3. A Ticket purchased under these GTC constitutes, in accordance with these GTC, a “valuable document” on the basis of which the Customer is entitled to enter the attractions at the Bachledka Ski & Sun resort according to the type of product purchased.
4. The Customer becomes the owner of the Ticket once payment of the one-time Admission Fee pursuant to the Price List has been credited to the Seller’s account in accordance with the payment (Article 4 of these GTC) and delivery terms (Article 5 of these GTC).
5. Pursuant to Section 19(1)(l) of the Consumer Protection Act, in the case of a distance contract, the contract with the Vendor is concluded at the moment the Ticket is delivered to the Customer’s email inbox (points 4.7 and 5.1 of these GTC). The subject matter of the contract is the provision of services by the Seller related to leisure activities, under which the Seller undertakes to provide such services at an agreed time or within an agreed period, with the subject matter, including the rights and obligations arising from the contract, being specified in these GTC (hereinafter referred to as the “Contract“).
6. In connection with point 1.5 of these GTC and in conjunction with Section 19(1)(l) of the Consumer Protection Act, in the case of a distance contract, the Customer is not entitled to withdraw from the Contract.
7. Pursuant to Section 14(6) of the Consumer Protection Act, in the case of a distance contract, the following applies: “The provisions of Sections 14 to 22 of this Act do not apply to a contract for the carriage of persons.”
8. The term of validity of a specific Contract corresponds to the term of validity of the relevant Ticket; points 2.2 to 2.4 of these GTC shall apply accordingly.
2. Customer’s rights and obligations related to the Ticket
1. The Customer is solely responsible for not using the Ticket for the attractions at Bachledka Ski & Sun during its validity period and may not request the Seller to refund the Admission Fee or provide any other performance for such unused Ticket. The Seller shall also not be liable to the Customer for the inability to use the Ticket for the attractions at the Bachledka Ski & Sun resort during its validity period in the event of force majeure, meaning an obstacle that arose independently of the Seller’s will and prevents the Seller from allowing the Customer to enter the attractions at the Bachledka Ski & Sun resort, where it cannot reasonably be expected that the Seller would have prevented or overcome such obstacle or its consequences. Force majeure includes, in particular but not exclusively, adverse weather conditions that could endanger the Customer’s safety on the attractions at the Bachledka Ski & Sun resort, or any regulations, measures, decisions, guidelines, instructions or legal provisions, as well as other normative administrative acts and individual administrative acts of legal force adopted or issued in connection with the spread of a particular dangerous infectious disease (e.g. COVID-19), as a result of which the attractions at the Bachledka Ski & Sun resort cannot be operated for the public.
2. The validity period of the Ticket is set by the Customer directly at the time of purchasing the Tickets. The validity period may be changed no later than 48 hours before the day of the visit by sending an e-mail request to change the date to info@bachledka.sk or by sending a written notice by post to Bachledka SKI & SUN s.r.o., with its registered office at Ždiar 702, 059 55 Ždiar. The visit date under the changed Ticket validity period must not exceed 1 year from the date of purchase of the Ticket.
3. The Customer is not entitled to offer the Ticket for resale; to allow another unauthorised person, for whom the Ticket was not purchased, to use it; to exchange the Ticket with another Customer; to create counterfeit Tickets; or to carry out any other actions that negatively affect the Seller. In the event of defects in the Ticket, the Customer is entitled to submit a claim in accordance with Article 6 of these GTC (Complaints Procedure).
4. The Ticket entitles the Customer to use the services and attractions available at Bachledka Ski & Sun, which are offered for a fee or free of charge at the Seller’s discretion. By purchasing the Ticket, the Customer acknowledges that the scope of services and attractions may change, particularly depending on the Seller’s operating possibilities and the season, and that certain services and attractions may be subject to a separate price list issued by the Seller.
5. In order to successfully enter the attractions at Bachledka Ski & Sun, the Customer is required to use the Ticket delivered by the Seller in accordance with Article 5 of these GTC. The Customer must use the Ticket at the turnstile in the form of the relevant barcode, either in physical (paper) or digital (electronic) form.
6. The Customer also acknowledges that, in addition to presenting the Ticket, they are required, before entering the attractions at Bachledka Ski & Sun, to present a valid identity document at the request of the Seller (or persons authorised by the Seller), for the purpose of verifying that the conditions for purchasing a discounted Ticket have been met.
7. Before entering the attractions at Bachledka Ski & Sun, the Customer is required to check the accuracy of the information on the Ticket. Any errors or typing mistakes must be reported without undue delay to the Seller in accordance with Article 6 of these GTC (Complaints Procedure).
8. Any modification, forgery, copying or other alteration of Tickets is expressly prohibited. Depending on the nature of the violation, the Seller will assess the legal consequences and liability of the person concerned under the applicable legislation, including criminal liability.
9. The Customer acknowledges that the operator of Bachledka Ski & Sun records the resort in designated areas using audiovisual equipment. The operator processes your personal data in the form of images and audiovisual recordings for the purpose of promoting its operations, in accordance with Article 6(1)(f) of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation). Images and audiovisual recordings from the resort are published on the operator’s website, Facebook page and elsewhere, and will be stored for a period of 10 years. As a data subject, you have the right to object to such processing at any time.
10. Any use of the Ticket for purposes not provided for by these GTC, i.e. other than a non-commercial visit and use of the services and attractions at Bachledka Ski & Sun, is inadmissible and prohibited under these GTC, unless otherwise specifically and demonstrably agreed.
11. By purchasing and using a Ticket for the attractions at Bachledka Ski & Sun, the Customer expresses their consent to the Visitor Regulations, the current and valid version of which is available on the Website https://bachledka.sk/navstevny-poriadok-chodnik-korunami-stromov, to the terms and conditions of use of the Bobsleigh track and the terms and conditions of use of Mountain carts, the current and valid versions of which are available on the Website www.bachledka.sk in the section Documents and to the attractions at Bachledka Ski & Sun, with which the Customer undertakes to familiarise themselves properly.
12. By entering the attractions at Bachledka Ski & Sun, the Customer undertakes to comply, in addition to the aforementioned Visitor Regulations, with the instructions of the Seller or persons authorised by the Seller.
13. In the event that the Customer breaches the Visitor Regulations or fails to follow an instruction of the Seller or a person authorised by the Seller, the Seller is entitled to remove the Customer from the attraction at Bachledka Ski & Sun, and the Customer is required to leave Bachledka Ski & Sun without undue delay. After being removed, the Customer is not entitled to request a refund of the Admission Fee or any other performance from the Seller, and the application of the provisions of Article 6 of the GTC (Complaints Procedure) is excluded. The Seller or a person authorised by the Seller is entitled to decide on the severity of the breach of the Visitor Regulations.
14. The Agreement is concluded for a fixed period, namely until the time when the Customer uses the services purchased with the Ticket.
3. Customer Zone
1. The Seller has established a Customer Zone for the direct purchase of Tickets for the attractions, accessible via the Website.
2. The Customer is not required to register on the Website in order to purchase a Ticket.
4. Price and Payment Terms
1. The amount of the Admission Fee and the individual admission categories are specified in the Price List, the valid and current version of which will be published on the Website. The amount of the Admission Fee in the Price List will always include VAT in accordance with Act No. 222/2004 Coll. on Value Added Tax, as amended.
2. Admission to the attractions is divided into several admission categories, corresponding to the division of the Admission Fee amounts in the Price List.
3. The current and valid Price List will always be published on the Website in the “Price List” section.
4. The price of Tickets and individual admission categories may be paid via the Website in the following manner:
a. by payment card through the CardPay system, which will be secured through a virtual POS terminal operated by VUB, a.s., where payment cards will be accepted. The Customer may use the aforementioned cards issued by any banking institution.
5. When purchasing a Ticket, the Customer selects the date of the visit, chooses a specific admission category in relation to the relevant Ticket, selects the number of Tickets, duly checks the personal data and is subsequently redirected to a page through which the Admission Fee will be paid.
6. On the day of the visit, Tickets may be purchased no later than 90 minutes before the end of the opening hours of the mountain resort.
7. After the Admission Fee has been credited to the Seller’s account, the Customer will automatically receive an electronic confirmation of the Ticket purchase, which will be sent by the Seller to the e-mail address provided by the Customer, together with the Ticket.
8. The Seller is obliged to issue an invoice upon the delivery of goods or services in the domestic territory to a taxable person or a legal entity that is not a taxable person within 15 days from the date of delivery of the goods or services or within 15 days from the date of receipt of payment. The obligation to issue an invoice does not apply to the taxable person if the request was sent more than 15 days after the date of receipt of payment. The Customer must send an official request to info@bachledka.sk together with the invoicing details and the order number.
9. On the basis of these GTC, the Seller is entitled to change the amount of the Admission Fee, including the overall composition of the Price List, as well as these GTC, once and at its own discretion, whereby the Price List and the corresponding GTC published on the Website at the time of purchasing the Ticket shall always apply to Customers.
5. Delivery and sending of the Ticket
1. A properly purchased Ticket, including a separate barcode (where proper purchase means the recording of payment of the Admission Fee pursuant to Section 4.7. of these GTC), will, where possible, be delivered to the Customer without undue delay to the e-mail inbox provided by the Customer in the relevant form when purchasing the Ticket.
2. Each Ticket delivered by the Seller to the Customer will contain the following details:
a. The date for which the Ticket is valid;
b. a barcode that will constitute a sufficient and independent element authorising entry to the selected attractions without the need to present the Ticket itself.
3. In order to ensure successful delivery of the Ticket, the Customer is obliged to pay the Admission Fee in full in accordance with the current and valid Price List; otherwise, the Seller is not obliged to deliver the Ticket to the Customer.
4. The Customer acknowledges that failure to deliver the Ticket caused by or resulting from incomplete, outdated or otherwise incorrect completion of personal data by the Customer, in particular the Customer’s e-mail address, shall not be the responsibility of the Seller.
6. Withdrawal from the contract
1. In the case of a Ticket, including individual types of electronic Tickets, it is not possible to withdraw from the contract with the Operator and request a refund of the Admission Fee, as pursuant to Section 19(1)(l) of the Act on Consumer Protection in the Sale of Goods or Provision of Services under a Distance Contract or a Contract Concluded Outside the Seller’s Premises, a consumer may not withdraw from a contract the subject of which is the provision of services related to leisure activities and under which the seller undertakes to provide such services at an agreed time or within an agreed period, whereas the contract for the purchase of a Ticket for Attractions constitutes a contract under which the seller, i.e. the Organiser, undertakes to provide the Ticket holder with a leisure service, i.e. Attractions, at an agreed time. A refund of a paid Ticket for Attractions is not possible unless these GTC provide otherwise. Likewise, the Ticket holder may not request a refund of the Admission Fee in the event that the Ticket is not used.
2. Pursuant to Section 14(6) of the Consumer Protection Act, the following applies to a distance contract: “The provisions of Sections 14 to 22 of this Act shall not apply to a contract for the carriage of persons.”
3. In the event of misuse or theft of a Ticket, the Ticket holder is obliged to report this incident to Bachledka Ski & Sun. as soon as possible by sending an e-mail to info@bachledka.sk or by written notification sent by post to the address of Bachledka Ski & Sun. If the incident has been reported to the police, the Ticket holder is also obliged to submit the police report to Bachledka Ski & Sun. If it is possible to verify the identity of the owner of the relevant Ticket, i.e. if the Ticket holder made a reservation and/or paid for the Ticket through their registration online at https://bachledka.skiperformance.com/, Bachledka Ski & Sun, following consultation with the Operator and its express approval, will issue the Ticket holder with a new replacement Ticket or, where applicable, a confirmation authorising the Ticket holder to enter the Attractions for which the lost/stolen Ticket was purchased.
4. In the event of damage to a Ticket, the Ticket holder is obliged to report this incident to Bachledka Ski & Sun as soon as possible by sending an e-mail to info@bachledka.sk or by written notification sent by post to the address of Bachledka Ski & Sun, and at the same time submit the damaged Ticket, or all of its parts, together with a sworn declaration describing the manner in which it was damaged. Bachledka Ski & Sun, following consultation with the Operator and its express approval, will issue the Ticket holder with a new replacement Ticket authorising the Ticket holder to enter the Attractions for which the damaged Ticket was purchased.
5. Bachledka Ski & Sun is entitled to withdraw from the contract with the person interested in purchasing the Ticket (Ticket Holder) if the person interested in purchasing the Ticket (Ticket Holder) reserves and/or purchases the Ticket and/or related services at a price that was published by mistake as a result of an internal error by an employee or worker of Bachledka Ski & Sun or the Organiser, or as a result of a technical error in the System, or if there is an obvious error in the display of the price (e.g. the price clearly does not reflect the usual or purchase price or is unusually low, provided that it is not a promotion, or one or more digits are missing from or added to the numerical price), regardless of the fact that the incorrect price is stated in the confirmation delivered to the person interested in purchasing the Ticket (Ticket Holder). Bachledka Ski & Sun is entitled to withdraw from the contract pursuant to the preceding sentence in writing, whereby the withdrawal may also be sent by email to the email address used by the person interested in purchasing the Ticket (Ticket Holder) when reserving and/or purchasing the Ticket to which the withdrawal relates, and may also take the form of information on the cancellation of the Ticket due to the display of an incorrect price or another relevant reason under this section. Bachledka Ski & Sun will subsequently cancel the reservation. Before withdrawing from the contract for the reasons set out in this section, Bachledka Ski & Sun is entitled to offer the person interested in purchasing the Ticket (Ticket Holder) to whom the withdrawal relates the option of paying the difference between the price paid and the correct Ticket price, whereby, upon payment of the difference, the Ticket remains with the person interested in purchasing the Ticket (Ticket Holder). In the event of payment of the difference pursuant to the preceding sentence, Bachledka Ski & Sun will send the person interested in purchasing the Ticket (Ticket Holder) confirmation of payment of the difference in the Ticket price and/or proof of payment of the full correct Ticket price.
7. Complaints Procedure
1. A complaint means asserting a defect in a Ticket, including a defect in a service associated with the purchase of a Ticket.
2. For the purposes of these GTC and to make the complaints procedure more efficient, a defect in a Ticket means, in particular, but not exclusively, the following cases:
a. The Ticket could not be delivered to the Customer’s email address;
b. The Ticket does not contain any of the particulars specified in Section 5.2 of these GTC;
c. payment was not completed in accordance with Article 4 of these GTC;
d. the relevant information is not stated correctly or accurately on the Ticket;
e. the Ticket contains a different admission category;
f. the Ticket contains errors and defects that prevent it from being used for the purpose intended by these GTC (i.e. in particular, allowing admission to attractions), etc.
3. In order to make the complaints procedure more efficient, the Customer is obliged to state a brief reason for the complaint; a reference to any of the reasons listed in Section 7.2 of these GTC, or to another reason at the Customer’s discretion, is sufficient.
4. The Customer is entitled to submit a complaint to the Seller without undue delay in a demonstrable manner, in particular by the following means:
a. by sending a written complaint to the Seller’s registered office address, enclosing the printed defective Ticket or, where applicable, a photograph of the defective Ticket; for the purposes of the complaints procedure, it is also sufficient to provide the identification number of the defective Ticket;
b. by sending a complaint email via the online form on the website www.bachledka.sk or to info@bachledka.sk, which has been specifically designated by the Seller for handling complaints; point a) of this section shall apply accordingly;
For the avoidance of any doubt, all the above-mentioned methods are equivalent.
5. The complaints procedure begins upon delivery of the complaint pursuant to Section 7.4 of these GTC and shall be completed no later than within 30 days from the date on which the complaint was submitted.
6. As part of the complaints procedure, the Seller shall assess whether the complaint is justified or unjustified and, in each case, shall issue the Customer with written confirmation of the manner in which the complaint was handled.
7. If the complaint is justified, the Seller shall send a new or corrected Ticket to the Customer’s email address within the time limits set out in Section 7.5 of these GTC.
8. At the Seller’s discretion, the outcome of the complaints procedure may, in addition to the confirmation under Section 7.6 of the GTC, also include a proposal for resolving the complaint and, having regard to the circumstances of the complaint, a simple proposal for remedying the errors and defects in the Ticket.
9. If the complaint is unjustified, the confirmation of the manner in which the complaint was handled shall include a brief explanation by the Seller of the reasons for rejecting the complaint.
10. If the complaint was submitted pursuant to Section 7.4, point b) of these GTC, the Seller shall send confirmation of the handling of the complaint to the Customer’s email address.
11. For the effective exercise of the Customer’s rights as a consumer in the complaints procedure, the Customer may contact the Seller’s authorised person at the contact telephone number +421 911 977 455, who shall inform the Customer about consumer rights and the options for resolving the complaint in question, in particular about rights under the Consumer Protection Act and Sections 622 and 623 of the Civil Code.
12. The Mountain Resort shall not be liable for damage caused by force majeure, natural conditions or weather, by the injured party’s own fault or by a third party for whom the Mountain Resort is not responsible, including an unforeseeable power outage lasting continuously for less than one hour, or for any inconvenience that does not depend on the actions of the Mountain Resort.
13. If the Customer is not satisfied with the manner in which the Seller handled their complaint or believes that the Seller violated their rights, they may contact the Seller with a request for remedy by e-mail at info@bachledka.sk. If the Seller rejects the request for remedy or fails to respond to it within 30 days from the date on which the request was sent, the Customer has the right to submit a proposal to initiate alternative dispute resolution pursuant to Section 11 et seq. of Act No. 391/2015 Coll. on Alternative Resolution of Consumer Disputes and on Amendments to Certain Acts, as amended. The competent entity for alternative resolution of consumer disputes with the Seller is the supervisory authority: Slovak Trade Inspection, with its registered office at: Prievozská 32, 827 99 Bratislava, Company ID No.: 17 331 927, which may be contacted for this purpose at Slovak Trade Inspection, Central Inspectorate, Department of International Relations and Alternative Dispute Resolution, Prievozská 32, 827 99 Bratislava 27, website: www.soi.sk, or another legal entity authorised to do so and registered in the list of entities for alternative resolution of consumer disputes maintained by the Ministry of Economy of the Slovak Republic, available at https://www.mhsr.sk/obchod/ochrana-spotrebitela/alternativne-riesenie-spotrebitelskych-sporov-1/zoznam-subjektov-alternativneho-riesenia-spotrebitelskych-sporov-1. The Customer has the right to choose which of the listed entities for alternative resolution of consumer disputes to contact. The Customer may use the online dispute resolution platform to submit a proposal for alternative resolution of their dispute, available at https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home2.show&lng=SK.
14. Points 7.1 to 7.13 of the GTC apply to the Customer who is a consumer, while, with regard to the Customer who is a legal entity/business operator, they apply accordingly, depending on the nature of the relevant provision.
15. Cableways – ticket/skipass: in the event of purchasing any of the offered cableway Services through the online shop at www.bachledka.sk, the concluded contract is subject to Section 14(6) of the Act on Consumer Protection in the Sale or Provision of Services Based on a Distance Contract or a Contract Concluded Outside the Seller’s Business Premises and on Amendments to Certain Acts, as amended, and it is not possible to withdraw from the contract, as the aforementioned Act excludes the application of the Act to contracts for the carriage of persons. By purchasing a ticket that also includes a cableway ticket, a contract for the carriage of persons for a fixed period is concluded between the seller and the Customer pursuant to Section 760 of Act No. 40/1964 Coll., the Civil Code. The contract terminates upon the carriage of the person in accordance with the purchased ticket. The ticket price is stated in accordance with the GTC applicable to the sale of tickets for attractions at the Bachledka Ski & Sun Resort in the price list published at www.bachledka.sk. The provisions of the Consumer Protection Act on withdrawal from a contract do not apply to withdrawal from the contract (the contract for the carriage of persons governing the relationship between the Customer and the seller), as the application of this Act with regard to withdrawal from the contract is excluded for contracts for the carriage of persons pursuant to Section 14(6) of the Consumer Protection Act. Adverse weather is not a reason for withdrawal from the contract.
8. Final Provisions
1. The Customer declares that, before purchasing the Ticket, they familiarised themselves with these General Terms and Conditions and fully agree with them. If the contract is concluded via the website www.bachledka.sk, the contract is concluded by the Customer, as the prospective ticket buyer, expressing their consent by confirming the designated field marked “I agree to purchase the ticket under the above conditions with an obligation to pay”, thereby approving all previously entered and displayed information. The contract is concluded in the Slovak language.
2. The legal relationship between the Seller and the Customer is governed by the laws of the Slovak Republic. The provisions of these GTC apply to the Contract as a matter of priority, followed by the relevant provisions of the Civil Code and then the provisions of the Consumer Protection Act and the Consumer Protection Act applicable to distance contracts.
3. The Seller declares that these General Terms and Conditions were drafted and adopted in good faith for the purpose of complying with statutory requirements and regulating fair relations between the Seller and the Customer, including consumer rights. If any provisions of these GTC are found by the competent authority of the Slovak Republic (the Slovak Trade Inspection) to be invalid or unenforceable, whether in whole or in part, the validity and enforceability of the remaining provisions and the remaining parts of the relevant provision shall remain unaffected, and the Seller shall remedy the situation within a short period. Remedy also includes the adjustment and amendment of the affected provisions of these GTC.
4. In view of the above, it also applies that if any provision of these GTC becomes invalid or ineffective, a provision whose meaning most closely approximates that of the invalid or ineffective provision shall be substituted for it. The invalidity or ineffectiveness of one provision of the GTC shall not affect the validity and effectiveness of the remaining provisions of the GTC.
5. In the event of disputes, the Seller and the Customer undertake to resolve their mutual disputes and claims out of court, in particular through mutual negotiations conducted in good faith and through fair communication, including the procedure regulated under Article 6 of these GTC (Complaints Procedure). If the Seller and the Customer fail to resolve any disputes in accordance with the preceding sentence, either party is entitled to resolve the dispute through court proceedings. In the event of court proceedings, the jurisdiction of a Slovak court shall apply in accordance with the rules laid down in the relevant legislation of the Slovak Republic, i.e. Act No. 160/2015 Coll., the Civil Dispute Procedure Code, as amended.
6. The Seller declares that it shall not be liable to the Customer for lost profits, loss of opportunities or any other indirect or consequential losses resulting from negligence, breach of these GTC or any other damage incurred as a result of a breach of an obligation on the part of the Customer.
7. The terms and conditions for the processing and protection of the personal data of Customers as data subjects within the meaning of the GDPR Regulation are transparently published on the Website in the “Documents” section.
8. The Resort reserves the right to change the price list during ongoing events.
9. These General Terms and Conditions entered into force and effect on 01.11.2026.
