5. Cookie Policy

a) What are Cookies?

Cookies are small files that store information in your browser and are generally used to distinguish individual users. However, the user cannot be identified based on this information.

b) Why do we use Cookies

  • for the proper functioning of our websites, so that the reservation process can be completed with as few difficulties as possible.
  • to determine which pages and functions visitors use most frequently.

c) What cookies do we use:

In terms of their duration, the cookies used on our websites can be divided into two basic types. Short-term so-called “session cookies”, which are temporary and remain stored in your browser only until you close it, and long-term so-called “persistent cookies”, which remain stored on your device for much longer or until you delete them manually (the length of time cookies are stored on your device depends on your cookie settings and browser settings).

In terms of the function performed by individual cookies, they can be divided into:

  • conversion cookies, which allow us to analyse the performance of various sales channels
  • tracking cookies, which, in combination with conversion cookies, help analyse the performance of various sales channels
  • remarketing cookies, which we use to personalise advertising content and target it correctly
  • analytical cookies, which help us improve the user-friendliness of our website by understanding how users use it
  • essential cookies, which are important for the basic functionality of the website

Some cookies may collect information that is subsequently used by third parties and that, for example, directly supports our advertising activities (so-called “third-party cookies”). However, you cannot be identified based on this data.

The cookies we use enable us to improve our websites.

If you do not want to accept cookies, you can adjust your browser settings. The help function directly in your browser explains how to change this setting. You can also visit the website www.aboutcookies.org, which contains comprehensive information on how to manage cookies in a wide range of browsers.

Please note that by blocking cookies, you may not be able to use all the functions of these websites to the full, especially the use of the reservation system to complete a reservation.

6. Which entities have access to your personal data?

We use the services of external processors and third parties: Slovenská pošta a.s., Slovak Parcel Service s.r.o. , BAJAN company s.r.o., Tatra banka a.s., Google LLC, The Rocket Science Group, LLC, Chodník korunami stromov s.r.o, Ing Milan Juraška, HGdata s.r.o., Tatranská horská služba – dobrovoľný zbor, SAYTECH, s.r.o., TATRY SUPER SKI Sp. z o.o. We ensure that all processors comply with applicable laws, are bound by confidentiality, process your data exclusively within the scope of the concluded contracts, and protect it appropriately in accordance with the requirements of the GDPR, international standards and applicable regulations.

7. How long will we retain your personal data?

Your personal data, which you entered in our order form when purchasing one of the products in our e-shop, is processed for the purpose of fulfilling pre-contractual and contractual relationships. We need all the data you provide through the order form to process your order smoothly, properly and quickly. We process and retain your data for a period of 3 years. We do not provide your personal data to other entities. By sending an email to suhlas@bachledka.sk  you may object to the processing and retention of your personal data and may also request its deletion.

Some data is processed for the period stipulated by law for its archiving (e.g. accounting and tax regulations, legislation governing archiving and records management, etc.), for the period necessary to establish legal claims (e.g. in the event of a complaint), or for the period necessary to achieve the purpose (e.g. if you contact us with a question about a specific product and the transaction is ultimately not concluded, we will delete your data immediately after answering your question = the purpose has been achieved).

Personal data obtained by completing the contact form for the purposes of pre-contractual relationships is processed only for the period necessary to achieve the purpose. If the contract is not performed, we process your data only for the purpose of handling your question or request. Immediately after this has been handled, your data is deleted from our database. Personal data obtained by completing the contact form for the purposes of fulfilling a contract (e.g. purchase of a product or service) is processed exclusively for a period of 3 years.

We process personal data obtained with your consent (for subscribing to the newsletter) for this purpose for a maximum period of 3 years from the date consent is granted, after which we will delete this data from our database. If you are our active customers (= you respond to offers from the newsletter or repeatedly order goods or services from us), we may process your personal data for a longer period. We do not provide your email address to other entities. You may, of course, withdraw your consent to the processing of your personal data at any time by sending an email to suhlas@bachledka.sk.

8. What rights do you have in connection with the processing of your personal data?

a) Right of access to personal data:

You have the right to ask us to confirm whether we process personal data concerning you and, if so, you have the right to access this personal data.

b) Right to rectification of personal data:

You have the right to have your personal data rectified if it is inaccurate or incomplete.

c) Right to erasure (right to be forgotten):

We are obliged to erase your personal data without undue delay if:

  • the personal data is no longer necessary for the purposes for which it was collected or otherwise processed;
  • you withdraw your consent on which the processing is based;
  • there is no other legal basis for processing your personal data;
  • you object to the processing and no overriding legitimate grounds for the processing exist;
  • you object to the processing;
  • the personal data has been processed unlawfully;
  • the personal data must be erased in order to comply with a legal obligation under EU or Slovak law;

The controller does not grant a request for erasure where processing is necessary:

  • for the performance of a task carried out in the public interest or in the exercise of official authority;
  • for reasons of public interest in the area of public health;
  • for archiving purposes in the public interest, for scientific or historical research purposes or for statistical purposes;
  • for the establishment, exercise or defence of legal claims.

d) Right to restriction of processing of personal data:

You have the right to ask us to restrict the processing of your personal data in one of the following cases:

  • if you contest the accuracy of the personal data, we will restrict its processing until we verify its accuracy;
  • if we process your personal data unlawfully and you object to the erasure of the personal data and request the restriction of its use instead;
  • we no longer need your personal data, but you need it for the establishment, exercise or defence of legal claims;
  • if you object to the processing of your personal data, we will restrict its processing until it is verified whether our legitimate interests override your reasons.

Where processing has been restricted, such personal data may, with the exception of storage, be processed:

  • only with your consent;
  • for the establishment, exercise or defence of legal claims;
  • for the protection of the rights of another natural or legal person;
  • for reasons of important public interest.

e) Right to data portability:

You have the right to obtain your personal data that you have provided to us and the right to transmit this data to another controller (e.g. when changing the provider of a particular service). Upon your request, we are obliged to provide you with your personal data in a structured, commonly used and machine-readable format (e.g. XML or CSV).

f) Right to object

You have the right to object at any time to the processing of personal data concerning you for the purposes of direct marketing. If you object to processing for direct marketing purposes, we will no longer use the personal data for such purposes.

10. Notification obligation in connection with the rectification or erasure of personal data or restriction of processing

We will notify every recipient to whom the personal data has been disclosed of any rectification or erasure of personal data or restriction of processing, unless this proves impossible or requires disproportionate effort.

11. Automated individual decision-making, including profiling

When operating our website, we do not make any decisions based on automated processing, nor do we profile your personal data in any way.

12. Our website and social networks

The provision of social media functionalities also involves the processing of your personal data. Our social media partners, Facebook, Instagram, Tripadvisor and Twitter, may combine the information they have obtained from us with other data that you have provided to them or that they have obtained from you when you used their services.

For certain functions on our website, we use a third party as a supplier, for example videos embedded from YouTube and links to this service. All links to social media involve the processing of your personal data autonomously, not only on the basis of our instructions as the website operator.

Social media are therefore also in the position of processors, but in some cases also joint controllers within the meaning of the GDPR. Before you start using links to social media, you should therefore carefully read the personal data processing policy (Privacy Policy) of the relevant third party = social media platform.

13. Who can you contact in connection with the processing of your personal data?

If you have any questions or suggestions regarding the processing of your personal data or if you wish to exercise any of your rights, write to us at: suhlas@bachledka.sk.  You also have the right to lodge a complaint with the Office for Personal Data Protection of the Slovak Republic if you believe that your rights have been infringed.
